Casting Materials

This Addendum supplements the Murnane Casting Privacy Policy and applies specifically to the handling of performer headshots, self-tape submissions, demo reels, audition footage, and any other performance-related visual or audio content (“Casting Media”). It is designed to meet or exceed best practices in the theater and performing arts industry while complying with applicable New York State and New York City regulations, as well as relevant federal protections.
1. Scope of Coverage
This Addendum applies to all Casting Media submitted to Murnane Casting, whether submitted digitally, in person, or via third-party casting platforms. It covers initial submissions, callbacks, chemistry reads, and any related materials generated in the casting process.
2. Purpose and Use Restrictions
Casting Media will be used solely for legitimate casting purposes, including review by casting directors, producers, directors, and other authorized members of the creative team. Such materials will not be used for marketing, promotional, training, or unrelated commercial purposes without your explicit written consent.
3. Storage and Security
All digital Casting Media is stored on encrypted drives and/or secure, password-protected cloud systems that comply with the New York SHIELD Act’s “reasonable safeguards” requirements.
Physical media (e.g., printed headshots, DVDs, USB drives) is kept in locked storage accessible only to authorized casting personnel.
Access to Casting Media is strictly limited to staff and authorized production partners directly involved in casting decisions.
4. Watermarking and Anti-Misuse Protections
Where feasible, digital submissions may be watermarked with unique identifiers to prevent unauthorized sharing.
Murnane Casting maintains audit logs of who has accessed Casting Media in our systems, and can investigate suspected misuse.
Any confirmed misuse of Casting Media by a third party will result in immediate revocation of their access, notification to the performer, and, if appropriate, referral to legal authorities.
5. Distribution Limitations
Casting Media will only be shared with individuals or entities contractually bound to use it for the specific casting project for which it was submitted.
Distribution will be done via secure, access-controlled links or encrypted transfers.
We do not post Casting Media publicly unless explicitly authorized by you in writing.
6. Retention and Deletion Policy
Unsuccessful submissions: Deleted within three years of the project’s completion, unless retention is needed for legal or union compliance.
Contracted talent: Retained for the full duration of the production and for up to seven years afterward, in line with industry legal requirements.
Upon your written request, Murnane Casting will permanently delete your Casting Media from active storage within 30 days, unless retention is legally required.
Deleted media will be purged from all active servers and secure backups, except where archival copies are required by law or union agreement.
7. Third-Party Platforms
If you submit via a third-party casting platform (e.g., Actors Access, Casting Networks), that platform’s privacy policy and terms also apply.
We select third-party partners who maintain strong security practices and comply with New York privacy laws.
8. Performer Rights
In addition to the rights outlined in the main Privacy Policy, you have the right to:
Request a list of all parties with whom your Casting Media has been shared for a specific project.
Request deletion of Casting Media outside of standard retention timelines (subject to legal constraints).
Receive confirmation when deletion is completed.
Report suspected misuse to Murnane Casting and, if applicable, the New York State Division of Consumer Protection.
9. Compliance with New York Law and Industry Standards
This policy is designed to comply with:
The New York SHIELD Act’s data security requirements
New York State Civil Rights Law § 50 and § 51 regarding the use of an individual’s likeness
Applicable labor laws for child performers
Union rules, including Actors’ Equity Association and SAG-AFTRA guidelines for self-tape and audition material handling
10. Enforcement and Breach Notification
If there is a security breach involving your Casting Media, we will notify you and any required state or city agencies within the timelines set by New York data breach notification laws.
